12.1 The Buyer shall book shipping space and inform the Seller by Fax of the name and telephone of the carrier, the name of the vessel, the date of arrival, loading port, loading date, within(Fill in the agreed time)days after signing this Contract but at least fifteen (15) days before the shipment date.

12.2 Subject to the Buyer fulfilling its responsibility in accordance with Article 10 and 12.1of this Contract, the Seller shall inform the Buyer of the Contract number, the name, quantity, total amount of the goods ready for loading, within three (3) days before the shipment.

12.3 Subject to the Buyer fulfilling its responsibility in accordance with Article 10 and 12.1of this Contract, the Seller shall load the goods at the port of shipment within the time of shipment and shall, within three (3) days after loading the goods, give a shipping advice to the Buyer. The shipping advice includes the Contract number, name of goods, quantity, and invoiced value.

12.4 In case of any other defaults by the Buyer other than failure to perform the obligations under Article 10, the Seller shall be entitled to postpone the shipment date and not be liable for any results due to such postponement, without prejudice to, in its sole discretion, passing its all additional costs and losses on to the Buyer to bear.

12.5 Within 60(sixty) days from receiving the notice of warehousing from the Seller indicated in Article 6, the Buyer shall complete the shipment of the goods. Due to the Buyer the goods not be shipped, the Buyer shall pay the Seller storage fee, the calculator standard and formula of storage fee detailed in Annex 1.

12.6 The goods not yet be shipped by the Buyer, the Seller shall, without prejudice to 12.5, be entitled to, in its sole discretion, dispose of the goods and pass it’s all additional costs and losses on to the Buyer to pay, which including not limited to carriage fee incurred for taking back the goods from the loading port to the Seller’s storage, etc.

12.7 Transshipment is allowed.

12.8 Partial shipment is allowed.
